PHOTOGRAPHY CONTRACT

This Photography Contract (the "Agreement") is made on [DATE] between:

Photographer: [PHOTOGRAPHER NAME], located at [ADDRESS] ("Photographer"); and

Client: [CLIENT NAME], located at [ADDRESS] ("Client").

1. SERVICES
The Photographer will provide photography services for:
[EVENT / SESSION TYPE]

2. DELIVERABLES
The Photographer will deliver approximately [NUMBER] edited photos within [NUMBER] days after the shoot, via [DELIVERY METHOD]. Editing style is at the Photographer's professional discretion.

3. PAYMENT
Total fee: [AMOUNT].
A non-refundable deposit of [AMOUNT] is due to reserve the date. The balance is due by [DATE]. Late balances may delay delivery.

4. COPYRIGHT AND USAGE
The Photographer retains copyright of all images. On full payment, the Client receives a personal-use license to print and share the delivered photos. Commercial use requires the Photographer's written permission and may involve an additional fee.

5. MODEL RELEASE AND PORTFOLIO USE
The Photographer may use images from the shoot for portfolio, website, and marketing purposes unless the Client requests otherwise in writing before the shoot.

6. RESCHEDULING
If the Client needs to reschedule, they will give at least [NUMBER] days' notice. The deposit may be applied to a new date subject to availability.

7. CANCELLATION
If the Client cancels, the deposit is non-refundable. Amounts paid beyond the deposit will be refunded, less any costs already incurred. If the Photographer must cancel, they will refund all payments or, with the Client's approval, arrange a qualified replacement.

8. FAILURE TO DELIVER
If the Photographer cannot deliver due to circumstances beyond their control (illness, equipment failure, or loss of images), their liability is limited to a refund of amounts paid. The Photographer is not liable for indirect or consequential losses.

9. GENERAL PROVISIONS
(a) Governing Law. This Agreement is governed by the laws of [STATE/COUNTRY].
(b) Entire Agreement. This Agreement is the complete agreement between the parties and replaces any prior discussions, understandings, or agreements on this subject.
(c) Amendments. Any change to this Agreement must be in writing and signed by both parties.
(d) Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
(e) Waiver. If a party does not enforce a provision, it does not give up its right to enforce that or any other provision later.
(f) Assignment. Neither party may assign or transfer this Agreement without the other party's prior written consent.
(g) Notices. Any notice under this Agreement must be given in writing (email is acceptable) to the other party.
