How to Write a Photography Contract

A photography contract protects the two things photographers most often lose money on: their time and their images. It sets what the client will get, what they can do with the photos, and what happens if the shoot is cancelled or postponed. Whether it is a wedding, a portrait session, or commercial work, a signed contract keeps expectations clear on both sides.

Our free photography contract template has these clauses built in. Here is what to put in each.

1. Nail down the shoot details

Record the date, start and end time, and location(s). For events like weddings, include the schedule and any second-shooter arrangements. Vague timing is how a two-hour shoot turns into six unpaid hours.

2. Define the deliverables precisely

State exactly what the client receives: number of edited images, format and resolution, delivery method, and the delivery timeline (e.g. "60 edited high-resolution images via online gallery within 4 weeks"). Specify how many revisions or re-edits are included.

3. Set the fee and the deposit

Write the total fee, the deposit required to hold the date, and when the balance is due. A non-refundable booking deposit is standard and protects you if the client cancels a date you turned other work away for.

4. Be explicit about image and copyright usage

This is the clause photographers most often get wrong. Decide and write down:

• Who holds the copyright (photographers usually keep it);
• What license the client gets — personal use, commercial use, print, social media;
• Whether you may use the images in your portfolio or marketing;
• Whether a model or property release is needed.

5. Cover cancellation and rescheduling

Explain what happens if either side cancels or needs to reschedule, how much notice is required, and what is refundable. Add a force majeure note for events beyond anyone's control (illness, extreme weather).

6. Sign before the shoot

Send the contract with the booking and get it signed — with the deposit — before you commit the date. Clients can sign from their phone in seconds; electronic signatures are valid, and you both get a copy with an audit trail. More in how to request a signature by email.
